1. Introduction

1.1 These Terms of Use apply to all orders you place through AsiaMarket (operated by EDENS S.A. (RCS Luxembourg B 43791), registered address: 28, Rue de l’Eglise 8025 Strassen, Luxembourg; email: services@moa.lu ; “we,” “us,” or “our”).
1.2 Please read these Terms carefully before placing an order. By placing an order on our website, you acknowledge and agree to be bound by these Terms.

2. Order and Contract Formation

2.1 When you submit an order on our website and complete the payment, we will send you an order confirmation by email or an on-site notification. At that point, a sales contract between you and our company is formed.
2.2 If an item is out of stock or we are otherwise unable to accept your order, we will inform you promptly. You may choose to cancel the unavailable items or replace them with alternative products.

3. Payment and Delivery

3.1 You must complete payment at the time of ordering or within any timeframe we specify. We reserve the right to refuse delivery if payment is not received in time.
3.2 Once your payment is received, we will process your order and arrange delivery according to your selected delivery method and schedule. Typically, orders begin processing within 24 hours.
3.3 If you provide an incorrect or incomplete address or contact details causing a failed delivery, we reserve the right to charge additional delivery fees or cancel your order.

4. Shipping and Receiving

4.1 Free Shipping Policy: If your order total exceeds 70 euros, shipping is free. In the event that some items are out of stock and the value difference is within 5 euros, you will still enjoy free shipping.
4.2 We will notify you by phone or SMS when the driver arrives at your delivery address or pickup location. The driver will wait for a maximum of 10 minutes. If you cannot receive the parcel and it is returned to our store, you may pick it up from our location within 48 hours. After this period, you will be responsible for any loss (especially for perishable or frozen goods).
4.3 Re-delivery or Alternative Pickup for Non-Perishable Items: If your order contains no fresh or frozen products and you are unable to receive the delivery at the scheduled time, please contact us by phone or email within 48 hours to discuss the possibility of arranging re-delivery or an alternative pickup. Additional fees may apply, depending on the situation and availability.

5. Product Standards and Inspection

5.1 We ensure that general goods are well-packaged and in good condition upon dispatch.
5.2 Fresh vegetables are shipped under proper conditions to maintain quality, minimizing spoilage due to transit.
5.3 Frozen foods are kept below 0°C throughout storage and transportation to maintain product integrity.

6. Group Purchase

6.1 If your order total exceeds 250 euros, you will receive a 5% discount on that order. If there are additional tiered discounts, we will publish them on the website.

7. Right of Withdrawal / Return & Refund Policy

7.1 Under EU consumer protection regulations, you have the right to withdraw from the purchase within 14 days from the day you receive the goods (except for fresh, frozen, or otherwise perishable items, or goods legally exempt from withdrawal).
7.2 To return a qualifying item, it must be in its original condition, with complete packaging. Please contact us at services@moa.lu before returning any item so that we can arrange return logistics or provide the return address.
7.3 We will process your refund via the original payment method within 14 days of receiving the returned item(s), provided all conditions for return are met.
7.4 For freshfrozen, or other perishable items, the 14-day withdrawal right does not apply as permitted by law.

8. Order Cancellation

8.1 You may cancel your order at any time before shipment. The refund policy will follow the conditions outlined above.
8.2 In the event of force majeure (such as natural disasters, war, governmental actions, or public health emergencies) making it impossible or impractical to fulfill your order, we reserve the right to cancel the order and issue a full refund.

9. Liability and Disclaimer

9.1 To the extent permitted by law, we are not liable for losses or damages caused by your own actions, third-party issues (e.g., courier errors, severe weather), or other matters beyond our reasonable control. We will, however, assist you in contacting the third party for possible resolutions.
9.2 We strive to ensure accurate product descriptions, pricing, and stock information on the website. If any obvious errors or inaccuracies are identified after you have placed an order, we reserve the right to correct them or cancel your order (with a full refund).

11. Governing Law and Jurisdiction

11.1 These Terms and any related disputes are governed by the laws of Luxembourg.
11.2 Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Luxembourg.
11.3 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

12. Changes to These Terms

12.1 We reserve the right to update or modify these Terms at any time to reflect legal changes or our updated business practices. Any such changes will be posted on our website, along with the new effective date. If you continue using our website after the changes become effective, you are deemed to have accepted those changes.
